PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE USING THIS SITE

  1. WHO WE ARE AND TERMS OF SERVICE
    1. Future Bee is a trading name of JALMA Limited, a company registered in England under company number 10780076 whose registered office is at 71-75 Shelton Street, Covent Garden, London, United Kingdom, WC2H 9JQ (Future Bee, we, us).
    2. Future Bee operates the futurebee.co.uk website (the Site).
    3. The Site provides its users with a platform for both Job seekers and Recruiters to connect regarding relevant potential employment opportunities. the (Services) including (without limitation):
      1.3.1 providing those actively looking for employment (Job seekers) with the opportunity to create user profiles (Job seekers profile) on the Site by entering certain information including contact details, experience and job search preferences; 
      1.3.2 providing the ability for third party recruiters (Recruiters) to create corporate profiles (Recruiters profile) by entering certain company information including contact details and to post jobs that they are recruiting for;
      1.3.3 the introduction of suitable Job seekers and Recruiters to each other (Introductions);
    4. Access to and use of the Site and the Services shall be at all times strictly subject to the terms and conditions of use set out in these terms of use (these Terms).
    5. These Terms (together with any further documents or policies expressly referred to herein) set out the legal terms and conditions on which we operate the Site and provide the Services. By using the Site and/or creating a Job seekers profile or Recruiters profile, you (you) confirm that you accept and agree to be bound by the Terms in relation to your access to and use of the Site, the Services and any further content or External Materials (as defined in clause 10.3 below) provided to you through the Site. If you do not accept and agree to these Terms, you must not access or use the Site or the Services. We recommend that you print a copy of these Terms for your future reference. You are also responsible for ensuring that any persons who access the Site using your internet connection are aware of these Terms and that they comply with them.

  2. FURTHER TERMS THAT MAY APPLY TO YOU
    1. These Terms expressly refer to the following additional policies which also apply to your use of the Site and the Services:
      2.1.1 Our Privacy Policy. which sets out terms upon which we process any personal data;
      2.1.2 Our Cookie Policy, which sets out information about the cookies on our site;                                                                  2.1.3 if you ae a company, our Recruiter terms and conditions (Recruiter Terms), which sets out additional information applicable to Recruiters.
  3. CHANGES TO THESE TERMS
    1. We may amend these Terms from time to time. Every time you wish to use the Site and/or the Services, please check these Terms to ensure you fully understand those that apply at that time.
  4. CHANGES TO THIS SITE
    1. We fully reserve our right without limitation (and without liability to you or any third party) and without notice to develop, modify, add to, remove from, suspend, or discontinue temporarily or permanently the Site and/or the Services (including your Profile) from time to time.
    2. Further, we do not guarantee that the Site, the Services, or any further content (including the External Materials) on the Site, will always be available or be uninterrupted.
  5. YOUR JOB SEEKERS PROFILE AND RECRUITERS PROFILE
    1. In order for you to create a Job seekers profile, we require that you provide a valid email address and mobile telephone number. The email and mobile telephone number you use must be one where we can reach you. You are solely responsible for any and all use of your Job seekers profile. You permit us to share information in your Job seekers profile with prospective employers, Recruiters, and others and for us to contact you via email or mobile telephone. Subject to visibility settings that you control, subscribers to services we may introduce (including Recruiters) will be able to view information on your Job seekers profile.
    2. Your Job seekers profile may be displayed to Recruiters if your  Job seekers profile matches their search requirements and you have applied for the job.
    3. Your email address, mobile telephone number and Job seekers profile information will be made available to the relevant Recruiter once you have applied for the job.
    4. In order for you to create a Recruiters profile, we require that you provide a valid email address and telephone number. The email and telephone number you use must be one where we can reach you. You are solely responsible for any and all use of your Recruiters profile. You permit us to share your contact information and information you share via job posts with Job seekers and for us to contact you via email or telephone. 
    5. We will only use any personal information you provide to us in accordance with our Privacy Policy.
    6. By accessing the Site and using the Services, you represent and warrant that:
      5.6.1 all information (in any form whatsoever and including personal information) submitted by you in creating or updating your Recruiters profile or posting jobs in the case of Recruiters or in creating or updating  your Job seekers profile, including a Job seekers responses to any Recruiter (your Information) is truthful, accurate and not misleading and you will maintain the accuracy of your Information and remove or amend it when it is no longer accurate;
      5.6.2 you own all of your Information or otherwise have the right to submit it for display or publication on the Site and to grant the licence set out at clause 6.2 and that the display or publication on the Site of your Information does not violate the privacy rights, copyright, contract rights or any other rights of any person, or otherwise breach any injunction, order or other legal ruling;
      5.6.3 your Information is not in any way (and could not reasonably be interpreted as being) threatening, abusive, malicious, pornographic, obscene, defamatory, illegal or otherwise inappropriate for publication on the Site; and
      5.6.4. you are 18 years of age or older.
    7. Any breach of clause 5.5 is likely to result in your right to use this Site ceasing automatically and with immediate effect (and may result in legal action being taken against you).
    8. In creating a Job seekers profile or Recruiters profile, you will be asked to use your email address for passwordless login. You are entirely responsible for maintaining the confidentiality of your email account. You agree not to use the  Job seekers profile or Recruiters profile or details of another Member (or any third party) at any time or to disclose your access information to any third party. You agree to notify us immediately by emailing hello@futurebee.co.uk if you suspect any unauthorised use of your Job seekers profile or Recruiters profile. You are solely responsible for any and all use of your Job seekers profile or Recruiters profile.
  6. INTELLECTUAL PROPERTY
    1. The Intellectual Property Rights in all software, text and visual content made available to you on this Site shall remain at all times the property of Future Bee (and its licensors). Such rights are protected by intellectual property and copyright laws and treaties around the world. All rights are expressly reserved by Future Bee (and its licensors).
    2. The Intellectual Property Rights in your Information shall remain at all times the property of you (and your licensors). By submitting your Information for display or publication on the Site, you grant to Future Bee a worldwide, sub-licensable, perpetual, transferable, non-exclusive, royalty free licence to use your Information in any way whatsoever including (without limitation) the transmission and distribution of your Information on and through the Site including the sharing of a Job seekers Information with Recruiters.
    3. If you suspect that any content on this Site may infringe any Intellectual Property Rights that you own or control, please email hello@futurebee.co.uk.
  7. LINKING TO THIS SITE
    1. You may link to the Site’s home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it.
    2. You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.
    3. You must not establish a link to this Site in any website that is not owned by you.
    4. This Site must not be framed on any other website, nor may you create a link to any part of our site other than the home page.
    5. We reserve the right to withdraw linking permission without notice.
    6. If you wish to link to or make any use of content on our Site other than that set out above, please contact hello@futurebee.co.uk.
  8. USE OF SITE CONTENT
    1. You agree that you will not:
      8.1.1 impersonate another person, or his or her email address, or misrepresent your current or former affiliation with an employer; or
      8.1.2 create user accounts and a Job seekers profile or Recruiters profile under false or fraudulent pretences; create or use an account for anyone other than yourself;
    2. You may store, display and print off one copy of any content supplied on the Site solely for your own personal use. You are not permitted to publish, manipulate, distribute or otherwise reproduce, in any format, any of the content or copies of the content supplied to you or which appears on this Site
    3. You must not modify the paper or digital copies you have printed off or downloaded (in accordance with clause 8.1) in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text. Further, our status and that of any identified contributors as the authors of content on this Site must always be acknowledged.
    4. We offer access to this Site to Job seekers for personal use only. You agree not to use this Site, the Services or any content or copies of the content provided via the Site in connection with any business or commercial enterprise without an express written licence to do so from us and/or our licensors (as appropriate).
    5. We have no liability to you for any loss of profit, loss of business, business interruption or loss of business opportunity that you may suffer in relation to your use of this Site and/or the Services.
    6. You may use the site for lawful purposes only. You may not use the Site and/or the Services:
      8.6.1 in any way that breaches any applicable local, national or international law or regulation including (without limitation) laws relating to discrimination, employment and human rights;
      8.6.2 in any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect; or
      8.6.3 to transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam).
    7. Any breach of this clause 8 will result in your right to use this Site ceasing automatically and with immediate effect and may result in legal action being taken against you.
  9. SITE SECURITY
    1. We do not guarantee that this Site and/or the Services will be secure or free from bugs or viruses.
    2. You are responsible for configuring your information technology, computer programmes and platform to access our Site. You should use your own virus protection software. We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer hardware, computer software, data or other property due to your use of this Site and/or the Services.
    3. You must not misuse this Site by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to this Site, the server on which this Site is stored or any server, computer or database connected to this Site. You must not attack this Site via a denial-of-service attack or a distributed denial-of service attack. By breaching this clause, you could commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities fully (and will disclose your identity to them to the extent that we are able to do so). In the event of such a breach, your right to use this Site will cease immediately.
  10. DISCLAIMER AND LIABILITY
    1. We make no representations, warranties or guarantees, whether express or implied, that your use of the Site and the Services will result in you receiving any Introductions, any offer in relation to any Job or any feedback from Future Bee or any Recruiters.
    2. The Site and the Services are provided for general information only and neither the Site nor the Services are intended to amount to advice on which you should rely. Although we make reasonable efforts to update the information on this Site, we make no representations, warranties or guarantees, whether express or implied, that the content on this Site is accurate, complete, up to date or error-free.
    3. The Site and the Services may contain links to and embed content from third party websites, platforms and/or resources. You acknowledge and agree that Future Bee does not control or endorse, and is not responsible for, any content, advertising, products, services or other materials on, transmitted from or available through such third party websites, platforms and/or resources (collectively External Materials), including without limitation the accessibility, accuracy, non-infringement, legality, decency, or any other aspect of the External Materials. Future Bee provides access to the External Materials to you without any endorsement of such External Materials. The use and access of such External Materials may be subject to different terms of use and privacy policies, which you are responsible for reviewing and complying with. You further acknowledge and agree that Future Bee shall not be liable for any damage or loss caused by or resulting from the access to, use of or reliance on any External Materials.
    4. The Site and the Services are provided to Job seekers free of charge, although we reserve our right to introduce a charge to Job seekers for the Services. Unless expressly stated to the contrary and to the fullest extent permitted by law, Future Bee and its licensors, content providers and advertisers hereby expressly exclude all conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity and shall not be liable for any loss or damages whatsoever, including (but in no way limited to) any direct, indirect, special, consequential, punitive or incidental damages, or damages for loss of use, profits, data or other intangibles, damage to goodwill or reputation, or the cost of procurement of substitute services, arising out of or related to the use, inability to use, performance or failures of this Site, the Services and any related materials or content (including but not limited to the External Materials), irrespective of whether such loss or damages were foreseeable or arise in contract, tort (including negligence), equity, restitution, by statute, at common law or otherwise. This does not affect Future Bee’s liability for death or personal injury arising from its negligence, nor for fraud or fraudulent misrepresentation or any other liability which may not be excluded or limited by law.
  11. LEGAL DISPUTES, LAW AND JURISDICTION
    1. We would rather attempt to resolve any dispute with you through good faith discussions before resorting to legal proceedings. Therefore, if you have any issue or complaint in relation to the Site, the Services or these Terms please write to us using address in clause 1.1 or the email address in clause 1.7.
    2. These Terms are governed by the laws of England and Wales. This means that any dispute or claim arising out of or in connection with these Terms will be governed by the laws of England and Wales. You and we both agree that the courts of England and Wales will have exclusive jurisdiction.

    1. The following definitions can be found in the relevant paragraphs, or as set out below:
      External Materials: see clause 10.3;
      Future Bee, we, us: see clause 1.1;
      Information: see clause 5.6.1;
      Intellectual Property Rights: means patents, utility models, rights to inventions, copyright and neighbouring and related rights, moral rights, trade marks and service marks, business names and domain names, rights in get-up and trade dress, goodwill and the right to sue for passing off or unfair competition, rights in designs, rights in computer software, database rights, rights to use, and protect the confidentiality of, confidential information (including know-how and trade secrets) and all other intellectual property rights including all rights in the graphic, photographic and textual content on the Site, in each case whether registered or unregistered and including all applications and rights to apply for and be granted, renewals or extensions of, and rights to claim priority from, such rights and all similar or equivalent rights or forms of protection which subsist or will subsist now or in the future in any part of the world.
